On Thursday, October 23, 2025, following a two month long investigation into the distribution of heroin
in Washington Borough, the Warren County Prosecutor’s Office Narcotics Task Force, and the
Washington Township Police Department executed a search warrant on the 200 block of Belvidere
Avenue. During the investigation, David Gallagher was identified as the suspect of this narcotics
investigation. David Gallagher was arrested, processed, and lodged in the Warren County Correctional
Center, pending the State’s Motion for Pretrial Detention.
Gallagher was charged on a Complaint Warrant with the offenses below.
- Maintaining or Operating a Controlled Dangerous Substance Production Facility, to grow
marijuana for distribution, in violation of N.J.S.A. 2C:35-4, a crime of the first degree;
- Manufacturing of Marijuana, in violation of N.J.S.A. 2C:35-5b(10)(b), a crime of the
second degree;
- Possession of a Controlled Dangerous Substance with the Intent to Distribute, within 500
feet of a public building, in violation of N.J.S.A. 2C:35-7.1a, a crime of the second
degree;
- Possession of a Controlled Dangerous Substance with the Intent to Distribute, within a
1000 feet of a school, in violation of N.J.S.A. 2C:35-7, a crime of the third degree;
- Possession of a Controlled Dangerous Substance, specifically suspected heroin, in
violation of N.J.S.A. 2C:35-10a(1), a crime of the third degree;
- Possession of a Controlled Dangerous Substance with the Intent to Distribute, in violation
of N.J.S.A. 2C:35-5b, a crime of the third degree,
- Possession of Drug Paraphernalia, in violation of N.J.S.A. 2C:36-2, a disorderly persons
offense.
First degree crimes carry a maximum sentence of (20) twenty years in the New Jersey State Prison.
Second degree crimes carry a maximum sentence of (10) ten years in the New Jersey State Prison. Third
degree crimes carry a maximum sentence of (5) five years in the New Jersey State Prison. Disorderly
persons offenses carry a maximum sentence of (6) months in County Jail.
The charges are merely accusations. The defendant is presumed innocent until and unless proven
guilty beyond a reasonable doubt in a court of law.
This investigation was conducted by the Warren County Prosecutor’s Narcotics Task Force and the
Washington Township Police Department. The Warren County Tactical Response Team assisted in
executing the search warrant.
