Waldwick Man Charged With Theft By Deception

Bergen County Prosecutor Mark Musella announced the arrest of 42-year-old JAN VINCENT B. AGAY of Waldwick, NJ, on the charge of theft by deception. The arrest is the result of an investigation conducted by the Bergen County Prosecutor’s Office under the direction of Deputy Chief Jeff Angermeyer.

In November of 2024, the Mahwah Police Department contacted the Bergen County Prosecutor’s Office Financial Crimes Unit regarding an alleged theft of funds from a corporation based in Bergen County, NJ. Following a lengthy investigation, detectives determined that JAN VINCENT B. AGAY, a former I.T. director who worked for the company, embezzled approximately $406,839.00 over the course of a two-year period. The investigation revealed that AGAY used company funds to purchase cryptocurrency mining hardware and virtual computing environments used for his own benefit, having no legitimate business purpose to his employer. The investigation further revealed that AGAY concealed this embezzlement by hiding these purchases among legitimate business expenses. Additionally, after the unauthorized mining activity was flagged by business security protocols, AGAY created security exclusions to intentionally suppress company security protocols that flagged the unauthorized purchases.

As a result of the investigation, JAN VINCENT B. AGAY was arrested on Tuesday, January 13, 2026, in Waldwick, NJ and charged with one count of second-degree theft by deception, N.J.S.A. 2C:20-4b. AGAY was remanded to the Bergen County Jail pending a first appearance in Bergen County Superior Court in Hackensack, NJ.

Prosecutor Musella states that the charges are merely an accusation and that the defendant is presumed innocent unless and until proven guilty beyond a reasonable doubt. He would like to thank the Mahwah Police Department and the Waldwick Police Department for their assistance.
